💡 On 01 January 2021, Labour Code 2019 officially takes effect, enterprises in general and their HR department in particular have encountered many difficulties in the application of this new law, especially in matters of labour discipline, internal labour regulations, severance allowance, job loss allowance,… Therefore, a specific guiding document for the Labour Code 2019 is becoming more and more necessary.

💡 On 14 December 2020, the Government of the Socialist Republic of Vietnam issued Decree 145/2020/ND-CP (officially entered into force on 01 February 2021) detailing and guidance on some articles of the Labour Code 2019 (“Decree 145”). Decree 145 covers many important contents, including some outstanding new points that enterprises need to pay attention to, specifically as follows:

  • Disciplinary procedures
  • Changes in the contents of Internal Labour Regulations
  • Employee book and employment report
  • Prior notice period upon unilateral termination
  • Severance allowance, redundancy allowance
  • Salary, bonus, overtime, night work pay
  • Employee’s consent to overtime work
  • Calculation of annual leave days (annual leave)
